Collision Liability

A family member had an accident with another car, rather than lose a discount to drive safely, we will pay the other driver for damages and not report the accident. I need to find a legally binding form for the other driver to sign that we assume any liability for the accident. We fear that the other driver may deny that we have ever paid.
