Legal liability is often used as a weapon to protect themselves off the timid or defend the brave. However, many staff and faculty engaged in study abroad programs have no concept of what the legal liability is and how it should guide the design and maintenance of all study abroad program.

Liability as a legal doctrine makes a person liable for damages and losses caused by its acts and omissions regardless of culpability (guilt is a measure of the extent to which a person can be held morally or legally responsible). However, for breach of contract or tort, guilt may increase the amount of damages payable to compensate the plaintiff.


Sources of liability


There is no question of our legal vocabulary and understanding, responsibility is something we are all bound. Based on different legal theories developed and precedence, duties and responsibilities imposed on us and can carry a compliance obligation.

Tort Law


Strict liability often applies to those who are engaged in hazardous or inherently dangerous business. The law imposes strict liability for what he regards as inherently dangerous. It discourages reckless behavior and needless loss requiring potential defendants to take all possible precautions. The tort is based on negligence for which damages may be awarded. common tort is generally measured by this question:


"A reasonable person would have known or should have foreseen the risk or harm?"


To prove negligence, the injured party must prove


1) the existence of an obligation which the offender does not respond, and


2) the specific effect of this failure resulted in injury to the plaintiff.

special relationship


In loco parentis is practiced at different levels in different types of campuses. For example, an institution linked to the church stringent codes of conduct raises a level of in loco parentis to a university funded by the State. However, most schools do not take responsibility in loco parentis. However, it is commonly accepted among international educators that we are bound to the expectations of the "special relationship" in which a duty of care is imposed because of special circumstances. Because there are more unknown factors involved in an international experience, there is a relative dependence.
