Am I covered??? During the storms last week tile fell from my house and hit the neighbors car.
I called the insurance company, which initially said no problem, the car is covered by our neighbors, "occupiers' liability" insurance (as expected). Now, however, they are stating that the neighbors claim their car insurance that we are not responsible, because they say the storm caused the slates to fall, not us personally!
It was a shock to us and does not seem fair at all - we have asked someone who worked for an insurance adjusters and they think we would be covered. Nobody works in insurance know where we are? We can not expect our neighbors to have to pay an excess and lose their no claim because of our house!
You (and your insurance company by the owner) are not responsible for that!
Your neighbors must wonder what THEIR insurance. If they do not cover model, it is out of their pocket.
This case is similar and all the news here in MO where we have been hammered by the storms. The only time you would be responsible if there is a risk that your neighbor asked you to reduce a timely manner and that you had failed to take timely action
An example would be a tree branch of a dead tree hanging over the property line and threatened to damage their property. When they brought the present to your attention and if you do not have to act within reasonable time and if they could prove they had asked you to resolve the problem, only then can you be held accountable. If we told you about it as the storm rolled in you probably would not be held responsible. If you had said a few weeks before when you could well be responsible. The key is that they must be able to prove that you are informed of the problem and the risk to their property.
Unless the slate roof was in disrepair and clear the neighbor had informed you of the danger of their property in advance of the storm, you and your insurance company are captured by the owner about it.
You should check your policy, but most insurance covers you during the storm, except fences and gates. But you must be covered, if insurance is not worth having.
What if a hailstorm hit and damaged your car neighbors? Is it the fault of anyone except nature? High winds and storm situations generally exempt the owner from liability such as roof shingles to find a vehicle. If you had a ladder leaning against your house and the wind blew a car it could be considered as negligence on your part, so it would be a loss covered under homeowners insurance. If your roof was being repaired and some additional slates placed on the slope of the roof just "fell" on the car for no apparent reason, it would also be covered. If you think it is wrong to just pay for all repair costs if your neighbor does not have to file a claim.
