Scottish Legal Life

Posted on March 20, 2010.
Scottish Legal LifeMy friend could not write his will, but was able to type on his laptop and print it?

he signed it and had two witnesses, she also signed, is it still legal although he typed? He lives in Scotland and is very concerned about the legality of it. I know that Scots law and English law are different, Thanks for your help.

I would say yes, but it is probably better to just get a lawyer and go ask him. It is somewhat too serious a question to ask a bunch of strangers on an Internet web page more than likely not live in Scotland or have legal under Scottish law. However, you may be lucky and get a lawyer to answer you here.

A will can be typed "accepted as a holograph in Scotland if the following conditions is met:
"A will must be handwritten or typed, entered into voluntarily and signed by two witnesses, neither of which should be a beneficiary of the will. You must name an executor who will carry out the terms of the will when you die."
It is covered by the requirements of Writing (Scotland) Act 1995 (link below).
The validity of the form of writing, however, does not guarantee the viability of the will contained therein. It is easy to make a bequest to invalidate a portion of the will and casts doubt on the rest. Best to get advice, Citizens Advice can be useful if legal fees are shocking.
Finally, I will not recommend the pre-set available. Most are useless north of the border, and none of them address the specific needs of the individual as well as a custom document.
I am a Scottish lawyer in another specialty, and I even consulted a lawyer about my will.
All the best.

Yes, he should be allowed legal, if it had signed by two witnesses.
Also, tell him there are "standard" is available on the net (for a very moderate price). They are easy to understand and complete, then just print them and have them sign and bingo. They are perfectly legal because they are fixed by legal experts.
